Terms of Service — Maths Dash

1. Acceptance of Terms

Welcome to Maths Dash. These Terms of Service ("Terms") constitute a legally binding agreement between you and Krida LLC ("Company," "we," "us," or "our") governing your access to and use of the Maths Dash mobile application and any related web pages, including pages hosted at kridallc.com/mathsdash/ (collectively, the "Service").

By downloading, installing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By using Maths Dash, you represent and warrant that you meet this age requirement. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. License to Use

Subject to your compliance with these Terms, Krida LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Maths Dash application on a device you own or control, solely for your personal, non-commercial purposes.

This license does not include the right to:

Reproduce, distribute, or publicly display any part of the Service
Modify, adapt, translate, or create derivative works based on the Service
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
Sublicense, sell, resell, transfer, or otherwise commercially exploit the Service
Remove or alter any proprietary notices, labels, or marks on the Service

4. Intellectual Property

The Service and all content within it — including but not limited to text, graphics, images, videos, audio, quizzes, lesson structures, user interface designs, logos, and software code (collectively, "Content") — are the exclusive property of Krida LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

All rights not expressly granted in these Terms are reserved by Krida LLC. Unauthorized reproduction, distribution, or use of any Content may result in civil and criminal penalties.

5. User Accounts

Certain features of the Service require you to create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain the security and confidentiality of your account credentials
Accept responsibility for all activity that occurs under your account
Notify us immediately if you become aware of any unauthorized use of your account
Not share your account credentials with any third party

We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for extended periods, or are created fraudulently. Account termination does not entitle you to a refund of any paid subscription amounts.

6. Subscriptions and Billing

Free Trial

Maths Dash offers a one-week free trial for new subscribers. The free trial begins when you initiate a subscription within the App. At the end of the free trial period, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee unless you cancel before the trial ends.

Automatic Renewal

Important: Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. By subscribing, you authorize Apple to charge your payment method on a recurring basis.

Subscription fees are charged to your Apple ID account at confirmation of purchase. Subscriptions may be managed and auto-renewal may be turned off by going to your Account Settings in the App Store after purchase. Cancellation takes effect at the end of the current billing period — you will retain access to premium features until that date.

Pricing and Changes

Current subscription pricing is displayed within the App at the time of purchase. Krida LLC reserves the right to change subscription pricing with reasonable advance notice. Price changes will apply at the start of the next subscription period following the date of the change. Your continued use of the Service after a price change constitutes acceptance of the new pricing.

Refunds

All subscription payments are processed by Apple through the App Store. Krida LLC does not directly process refunds. Refund requests must be submitted to Apple via reportaproblem.apple.com and are subject to Apple's refund policy. Krida LLC has no control over Apple's refund decisions.

Family Sharing

Where indicated during purchase, certain subscription tiers support Apple Family Sharing. Family Sharing eligibility and features are subject to Apple's Family Sharing terms and policies.

7. Prohibited Activities

You agree not to engage in any of the following activities in connection with the Service:

Violating any applicable local, state, national, or international law or regulation
Attempting to gain unauthorized access to any portion of the Service, other user accounts, or related systems or networks
Interfering with or disrupting the integrity or performance of the Service or servers connected to it
Introducing viruses, malware, ransomware, or any other malicious or harmful code
Scraping, crawling, or otherwise extracting data from the Service without our express written permission
Circumventing or attempting to circumvent any content protection, digital rights management, or subscription verification mechanism
Impersonating any person or entity, or falsely claiming an affiliation with any person or entity
Using the Service in any manner that could damage, disable, overburden, or impair it
Collecting or harvesting personal information of other users without their consent
Using the Service for any commercial purpose without our prior written consent

8. Educational Content Disclaimer

The educational content within Maths Dash — including mental math techniques, lessons, and exercises — is provided for general educational and informational purposes only. While we draw on established mathematical traditions and peer-reviewed research in designing our content, Krida LLC makes no representations or warranties regarding:

The accuracy, completeness, or suitability of any educational content for any particular purpose
Any specific learning outcome, skill improvement, or academic result that may or may not be achieved through use of the App
The appropriateness of content for any specific user's educational level or needs

The App is not a substitute for formal education, professional tutoring, or academic instruction. Krida LLC is not responsible for any decisions made based on content within the App.

9. Third-Party Services

The Service integrates with third-party services including Apple Sign-In, Google Sign-In, Firebase (Google LLC), and Apple's App Store. Your use of these third-party services is subject to their respective terms of service and privacy policies. Krida LLC is not responsible for the practices or content of any third-party services.

The Service may contain links to third-party websites or resources. These links are provided for your convenience only. Krida LLC does not endorse and is not responsible for the content, accuracy, or availability of any external sites or resources.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KRIDA LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT
WARRANTIES THAT ANY DEFECTS WILL BE CORRECTED

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply to the maximum extent permitted by law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KRIDA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, revenue, data, goodwill, or other intangible losses
Costs of procurement of substitute goods or services
Unauthorized access to or alteration of your account or data
Statements or conduct of any third party in connection with the Service
Any other matter relating to the Service

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF KRIDA LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY CASE, KRIDA LLC'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO KRIDA LLC IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Krida LLC and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Service; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit or transmit through the Service.

13. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

For any dispute, claim, or controversy arising from or relating to these Terms or the Service ("Dispute"), you and Krida LLC agree to first attempt to resolve the Dispute informally by contacting us at the address in Section 19. We will attempt to resolve the Dispute within 30 days.

If the Dispute is not resolved informally, you and Krida LLC agree that any Dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted in English. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Exceptions: Either party may seek relief in small claims court for Disputes within that court's jurisdiction. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

You have the right to opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to legal@kridallc.com with the subject line "Arbitration Opt-Out." Your notice must include your name and a statement that you wish to opt out of the arbitration agreement.

14. Class Action Waiver

YOU AND KRIDA LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. To the extent court proceedings are permitted under these Terms, you and Krida LLC submit to the personal and exclusive jurisdiction of the state and federal courts located in Jefferson County, Colorado.

If you are a consumer located in the EU, you may also have the right to bring claims before your local courts under applicable consumer protection laws, notwithstanding the above.

16. Termination

Krida LLC reserves the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, effective immediately. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent or illegal activity, conduct harmful to other users or to Krida LLC, or extended periods of inactivity.

Upon termination, your license to use the Service immediately ceases. Termination does not entitle you to a refund of any prepaid subscription fees. Sections that by their nature should survive termination — including Sections 4, 10, 11, 12, 13, 14, 15, and 18 — shall survive.

17. Modifications to Terms

Krida LLC reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, where appropriate, through in-app notifications or email. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service.

18. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Krida LLC regarding the Service and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter herein.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions.

Waiver

Krida LLC's failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Krida LLC.

Assignment

You may not assign or transfer these Terms or any rights hereunder without Krida LLC's prior written consent. Krida LLC may assign these Terms without restriction. These Terms are binding upon and inure to the benefit of the parties and their permitted successors and assigns.

Force Majeure

Krida LLC shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, government action, or internet or telecommunications failures.

No Third-Party Beneficiaries

These Terms do not and are not intended to confer any rights or remedies upon any person other than the parties to this agreement.

Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply: (a) These Terms are between you and Krida LLC only, not Apple; (b) Apple has no obligation to furnish any maintenance or support services for the App; (c) Apple is not responsible for addressing any claims relating to the App; (d) Apple is a third-party beneficiary of these Terms and may enforce them against you.
